Welcome to BrightView Care (“BrightView Care,” “we,” “us,” or “our”). BrightView Care provides Applied Behavior Analysis (ABA) therapy services, care coordination, administrative support, and related communications. These Terms of Service (“Terms”) govern your access to and use of the BrightView Care website, digital platforms, services, and communications, including text messaging (SMS) services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you should not use the Services.
By using the Services, you represent that you are at least 18 years of age or are a parent, legal guardian, or authorized representative acting on behalf of a minor or dependent receiving services. You agree to use the Services only for lawful purposes and in compliance with all applicable healthcare, privacy, and consumer protection laws. You agree not to misuse, interfere with, or attempt to gain unauthorized access to any portion of the Services.
The Services are intended to support administrative functions, communication, scheduling, and general informational purposes related to ABA therapy. Content provided through the Services does not constitute medical advice, diagnosis, or treatment and is not a substitute for professional clinical judgment. All clinical decisions are made solely by qualified healthcare professionals in accordance with applicable laws and professional standards.
All content made available through the Services, including text, graphics, logos, images, forms, educational materials, software, and design elements, is owned by or licensed to BrightView Care and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without prior written permission from BrightView Care.
Certain features of the Services may require you to submit personal information or protected health information or to create an account. You agree to provide accurate, current, and complete information and to update such information as necessary. You are responsible for maintaining the confidentiality of any login credentials and for all activity conducted through your account or on behalf of a client you represent.
Your use of the Services is subject to our Privacy Policy, which describes how we collect, use, and protect personal information, including information that may be considered protected health information. By using the Services, you consent to the collection and use of your information as described in the Privacy Policy, consistent with applicable privacy laws.
The Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, BrightView Care disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. BrightView Care does not guarantee uninterrupted access, error-free operation, or that the Services will meet all user expectations.
To the maximum extent permitted by law, BrightView Care shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of, or inability to use, the Services, including reliance on information provided through non-clinical communication channels.
These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to conflict of law principles. Any legal action or proceeding arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located within the State of Michigan, and you consent to the personal jurisdiction of such courts.
BrightView Care reserves the right to modify these Terms at any time. Updates will be effective upon posting. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.

SMS Terms and Conditions of Use
By opting in, you consent to receive and authorize BrightView Care (and its service providers) to send you recurring automated and non-automated text messages, including service-related, administrative, informational, and limited personalized communications (such as appointment reminders, scheduling updates, care coordination notices, and program updates) at the mobile number you provide or use when signing up, including messages sent using an automatic telephone dialing system. Your consent is not a condition of receiving therapy services or any other services. You may revoke this consent at any time by replying STOP. Message frequency varies. Message and data rates may apply.
You will receive a reply text message to confirm your signup. Your opt-in signifies your agreement to these SMS Terms and Conditions of Use and to the dispute resolution provisions contained within these Terms of Service, which govern how claims you and BrightView Care have against each other are resolved.
BY ACCEPTING THESE SMS TERMS, YOU ALSO AGREE TO OUR PRIVACY POLICY, WHICH IS INCORPORATED INTO THESE TERMS AND MAY BE UPDATED FROM TIME TO TIME. THE PRIVACY POLICY DESCRIBES HOW WE COLLECT, USE, AND PROTECT PERSONAL INFORMATION RELATED TO COMMUNICATIONS.
Message and data rates may apply. Message frequency will vary by user. BrightView Care reserves the right to alter the frequency of messages sent at any time. To participate, you must have a text-message-enabled mobile device and an active text messaging plan. Not all mobile devices or carriers may be supported, and text messaging may not be available in all areas. BrightView Care and its service providers are not liable for delayed or undelivered messages.
SMS messages are intended for administrative, informational, and service-related purposes only and are not a substitute for direct clinical communication, emergency services, or urgent care. Do not use SMS messaging to communicate medical emergencies.
For help, text the keyword HELP to the phone number or short code from which messages are sent at any time to receive customer care contact information.
To cancel, reply STOP to the number from which messages are sent. After opting out, you will receive one additional text message confirming that your request has been processed. If you opt out of one BrightView Care SMS program, you may continue to receive messages from other BrightView Care communication programs you have joined separately, including non-marketing or transactional messages related to active services, unless you separately opt out of those programs.
To opt in, submit a mobile opt-in form, enrollment form, intake documentation, or otherwise affirmatively consent by providing your mobile number through a BrightView Care scheduling, intake, or communication process.

Client, Caregiver, and Healthcare Communication Responsibilities
By using BrightView Care’s Services, you acknowledge that ABA therapy services involve ongoing collaboration between BrightView Care, clients, parents, legal guardians, caregivers, and authorized representatives. You agree to provide accurate, complete, and timely information related to a client’s care, scheduling, insurance coverage, and contact details, and to promptly notify BrightView Care of any changes that may affect services.
You acknowledge that electronic communications, including email, SMS text messaging, and online portals, are provided for administrative, scheduling, and general service-related purposes only. Such communications are not intended to replace in-person clinical discussions, formal treatment documentation, or emergency communication channels.
You agree not to use BrightView Care’s digital communications, including SMS messaging, to report medical emergencies, behavioral crises requiring immediate intervention, or urgent safety concerns. In the event of an emergency, you should contact local emergency services or follow established clinical escalation procedures provided by your care team.
You understand that while BrightView Care takes reasonable steps to safeguard communications and personal information, electronic communications may be subject to technical limitations, delays, or unintended access. By using these communication methods, you acknowledge and accept these risks.
You further acknowledge that compliance with treatment plans, attendance policies, caregiver participation requirements, and therapy recommendations is essential to the effectiveness of ABA services. BrightView Care is not responsible for outcomes affected by missed appointments, lack of caregiver participation, inaccurate information, or failure to follow agreed-upon care guidelines.
